End User Licence Agreement

End User Licence Agreement (EULA)

This End User Licence Agreement ("Agreement") is between you and Moss Lane Farm ("we", "us", "our") and governs your use of the Nature Recorder mobile application and any updates to it (the "App"). By downloading or using the App you agree to this Agreement, our Terms of Use and our Privacy Policy.

Licence

We grant you a personal, non-exclusive, non-transferable, revocable licence to install and use the App on a device you own or control, for your own non-commercial use of the Moss Lane Farm Nature Recorder, in line with this Agreement and the app store's usage rules. We (and our licensors) keep all rights, title and interest in the App; this Agreement does not sell the App to you.

Restrictions

You agree not to, and not to permit anyone else to:

  • copy, sell, rent, sub-licence or distribute the App;
  • modify, reverse engineer, decompile or disassemble the App, except to the extent the law expressly permits;
  • remove any proprietary notices; or
  • use the App unlawfully or in any way that damages or interferes with it.

Your content and conduct

Your use of the App, the wildlife records and media you submit, and your conduct are governed by our Terms of Use. Information the App collects and how we use it is described in our Privacy Policy.

Updates

We may release updates, and some updates may be required for the App to keep working. This Agreement covers those updates unless they come with separate terms.

App Stores

You obtained the App from a third-party store (for example Apple's App Store or Google Play). You agree to that store's applicable terms. For the Apple App Store, the following also apply:

  • This Agreement is between you and Moss Lane Farm only, not with Apple. Apple is not responsible for the App or its content.
  • Your licence to use the App is limited to a non-transferable licence to use the App on Apple-branded devices you own or control, as permitted by the App Store Usage Rules.
  • Apple has no obligation to provide maintenance or support for the App. Any support questions should come to us at hello@mosslanefarm.org.uk.
  • To the extent permitted by law, Apple has no warranty obligation for the App, and Apple is not responsible for any claims relating to the App (including product liability, legal/regulatory compliance, or consumer-protection claims) or for addressing any third-party intellectual-property claim about the App.
  • Apple and its subsidiaries are third-party beneficiaries of this Agreement and may enforce it against you.

No warranty

The App is provided "as is" and "as available" without warranties of any kind, to the fullest extent permitted by law. Community-submitted records are not verified scientific data.

Limitation of liability

To the fullest extent permitted by law, we are not liable for any indirect or consequential loss arising from your use of the App. Nothing limits liability that cannot be limited by law.

Termination

This Agreement applies until terminated. It ends automatically if you breach it; you may end it by deleting the App. On termination you must stop using the App.

Governing law

This Agreement is governed by the laws of England and Wales, subject to any mandatory consumer rights you have.
